Urgent request of the Speaker of the Parliament from the Central Bank to determine the task of digital currencies; Do not pay to unlicensed exchange offices until further notice


In an urgent letter to the Governor of the Central Bank and the Minister of Economy and Finance, the Speaker of the Islamic Consultative Assembly called for the assignment of digital currencies and action to prevent the provision of payment gateways to “unlicensed” activists in the field.

According to Arzdigital, Mohammad Baqer Qalibaf, Speaker of the Islamic Consultative Assembly, in an urgent letter to the Central Bank and the government, called for transparency in the regulation of digital currencies in Iran and to take action to prevent “losses to the people.” According to the letter, the central bank has been asked to refrain from providing payment gateways to unlicensed digital currency exchanges until the necessary licenses are issued, so that in case of loss to individuals due to the use of digital currency exchange payment gateways, the central bank should be held accountable. . The “reason for the continuation” of the payment gateway to digital currency exchanges must also be reported to parliament.

At the beginning of the letter, the possibility of the future of digital currencies and blockchain technology in China is mentioned, and then the possible risks in this area, such as the possibility of “currency outflow” and “creating illegal bases” are mentioned.

The letter goes on to say that despite the passage of years since the advent of the phenomenon of digital currencies, no effective action has been taken to determine the scope of legislation in this area. The letter specifically mentions digital currency exchanges for which there are no regulations.

The letter also states that according to statistics, the exchanges made in Iranian digital currency exchanges are equal to the “daily exchanges of shares in the capital market” and according to the text of this letter, the custodians in this area, namely the Central Bank and the Ministry of Economic Affairs and Finance, take effective action. Merely announcing a ban on cryptocurrency exchanges cannot relieve the important responsibilities of the Central Bank and the Ministry of Economic Affairs and Finance in this regard. The previous experience of unauthorized financial and credit institutions and similar actions of the Central Bank regarding these institutions, as well as sites such as Samen Coin, which has led to the loss of many people and the imposition of high financial costs on the country, should be taken into account.

“According to the laws and regulations of the country, any activity under the name of ‘exchange office’ in the country is allowed only with the permission of the Central Bank.”

An important part of the letter mentions the continuation of the payment gateway to digital currency exchanges, despite the announcement of the ban. According to this letter, in March 2017, the Central Bank announced to the holders of payment licenses to refuse to provide payment gateways to digital currency exchange sites; However, services are still provided through payment gateways under the supervision of Shaparak Company. The letter states:

One of the major concerns of economic activists and some members of parliament is that despite the announcement of the illegality of digital exchanges and while in March 2016 the Central Bank announced to the license holders to refuse to provide payment gateways to these sites, companies still The main payment gateway providers under the supervision of Shaparak, especially in the form of IPG, provide services to these sites. However, Shaparak is required to provide payment gateways to sites with the symbol of electronic trust.

In his letter, Qalibaf also referred to the possibility of a large outflow of foreign currency from the country due to the activities of exchange offices, and called for the presentation of an expert report by the Central Bank in this regard:

In case of real conversion of Rial funds paid by activists to these sites to cryptocurrencies extracted abroad, the possibility of large-scale outflow of currency from the country is probable because in this regard, it is necessary to provide an expert report and appropriate estimate by the Central Bank.

Qalibaf, referring to the responsibility of the Central Bank as the main custodian of the country’s monetary system, called for rapid legislation in the field of digital currencies by this institution:

In any case, it is necessary that the Central Bank, as the main custodian of the country’s monetary system, as soon as possible, while providing a reliable estimate of the future of this technology and its impact on the economy, especially the monetary system and exchanges, the necessary regulations for activity, especially in Develop the field of cryptocurrency exchanges and take action to systematize the activities in this field and prevent the provision of any payment gateway to unlicensed activists in this field until the necessary licenses are provided.

The Speaker of the Majles also demanded an explanation from the Central Bank about the reason for continuing to provide payment gateways to exchange offices, despite the warnings provided by the Islamic Consultative Assembly:

Despite the warnings provided by the Islamic Consultative Assembly to the Central Bank, it is necessary to provide a proper explanation about the reason for continuing to provide payment gateways to sites that according to the Central Bank have no license, and if people are harmed by the existence of licensed payment gateways from the Central Bank On these sites, the central bank must be held accountable.

Referring to the large volume of financial transactions in the context of digital currency exchanges, this letter asked the Ministry of Economy and the Tax Affairs Organization to file a tax file for the owners of these sites as soon as possible:

Despite the large volume of financial transactions in the context of these sites, it is necessary for the Ministry of Economy and Finance and the Tax Affairs Organization to create a tax file for the owners of these sites as soon as possible and submit the report to the Islamic Consultative Assembly as a matter of urgency.
